I gave Toni Michaels a Homestead Deed in 2018

Back in 2018, Toni Michaels was getting garnished on an old car repossession from three years before. I gave her a homestead deed, following my instructions, and sent her to court. That worked, she got back the money Credit Acceptance took from her payroll in 2018.


Then she did nothing. (Actually, she did set a follow-up meeting but canceled. Twice.)


The next year, Credit Acceptance tried to garnish her again--but they missed, She had changed jobs.


In the spring of 2023, they found her new job and garnished her pay for three months. As soon as that garnishment was over, they started a new garnishment and got her paycheck for four more months.


Since Credit Acceptance is adding interest and late fees, she still owes almost as much as she did when she saw me back in 2018.


Toni was in tears when she called me in April 2024 and I was upset, too. "If you had filed bankruptcy when we stopped that first garnishment, your credit score would be above 750 today. You could be a homeowner."


"I know," she said.


If you get a homestead deed and stop a garnishment, then you need to file bankruptcy

You can stop a garnishment one time and get back the money with a homestead deed. But they are not going to give up. Since they have a judgment they are allowed to keep trying to garnish you for twenty years. And sooner or later they will.

You can use a homestead deed to stop a garnishment, but unless you file bankruptcy, they will just do it again. Toni let them garnish her paycheck fourteen times.
